97banshee350 Posted June 9, 2005 Report Share Posted June 9, 2005 ok i got home from shool and i got the mail and i noticed a letter that had my fathers name on it and in the corner said elite performance racing in the corner from PA. so i opened it thinkin maybe some stickers or somthing(who knows) And its a 6 page packet or papers. on the top side it says HSBC then below it AFFIDAVIDIT OF REPOSSESSION so i read lower and this is exacly what it says, i dont really know what it means but.... state of Illinois (i live in connecticut) county of dupage HSBC retail servises being 1st duly sworn deposes for says (each for himself and not one for the other) that he is/are the owners of a cirtain repossessed 2001 YAMAHA YFZ350N-l VIN # JY43GG0361C023101. (THE SAME VIN ON MY 97 BANSHEE) sence being repossessed under previous of signed security agreement from: DENTON ROWLAND location: 3278 STEAM MILL RD, DONALSOMVILLE GA 39845 date: 12-27-04 Lisa Passi athorized repossession Agent 1-800-365-1327 i bought my 1997 banshee last may from this guy that way in the paper, like a 30 min drive from my house, do you guys know exacly what this means and did i buy a stolen banshee???? pimp559 Posted June 9, 2005 Report Share Posted June 9, 2005 If you didn't get a title with the bike it sounds like your screwed. It sounds like the previous owner sold your dad the bike with out a title and he still owed money on the bike. This guy probably came on hard times and quit making the payment. Now it is being reposessed. You have a couple options. 1. Tell the people that sent the letter that you will pay what is owed on the bike (not cool because you already payed for the bike). 2. Start parting the bike out to get back as much money as you can and tell them they can come pic up the frame (because is has a serial number on it). You don't want to get caught riding it because likely it will get impounded and you will loose everything you have into it. Sorry to here about your situation. 97banshee350 Posted June 9, 2005 Author Report Share Posted June 9, 2005 has that happened to anyone you know?? this is shit.....i just finished rebuilding it, its in like 100% shape and looks brand fuckin new. ......they cant do anything if i part it out and give them the frame...like make me pay for it still? cuz ill do that if i have to...what about this...i just bought a frame and rebiult everything, could i keep the shee at my friends house and give them the old frame? becaus i bought a new one sence i thought the old one was bent beause the way it looks up front...so i have the one frame that was on it, and i have already put the new one on....do you get what i mean? like hide the shee and give them the old frame? There are no numbers on the bike right now, due to the new frame...? If that is the case then.....you don't really know where that banshee is.....you traded it off or something.....no title or bill of sale. Flea market.. get my drift? Dude is gettin off easy who sold it to you..but i doubt he would if you only gave them the frame. So, sounds like you better get to work. Did you register the bike? Do you hav a title? 97banshee350 Posted June 9, 2005 Author Report Share Posted June 9, 2005 ok i just went outside and read my old 97 frame that was bent and its not that vin # that the sheet says, i bought a frame off ebay , that one has the same vin #, so go figure, i just got dont puttin it all back together. so apparenty, someone had the same problem, parted the shee, and sold the frame to me off of ebay and now they think i have that banshee but all i have is the damn frame.... Ducman Posted June 9, 2005 Report Share Posted June 9, 2005 I'd give the repo bitch the frame and tell them it was a POS when you bought it from him so you parted it out, say here's whats left, its all yours fockers! Park it at a friends or relatives that you dont go to very often for a couple monthes. If they still come at you then part it out and have a good friend e-bay the stuff for you. The more legal alternative is to give the bike to the repo bitch and sue the guy you bought it from, unfortunately if he is down and out you'll never see a dime, thats why if it were me I'd do it the first way.
