I caught a flat doing some trail ridding with family..Left the bike on the trailor figured that I would fix it this weekend. I go into my garage and get her out, didnt feel like swaping tires so I figured I would throw some tire slim in for a quick fix. With the tire slim you have to get the tire inflated and moving asap. So I said to myself I would role her down the street in first gear for 2-3minutes to get it circulated. I had a couple of kids in the street with a basketball hoop, so to avoid hurting them I did it on the sidewalk because there was no kids. As Im ridding I hear the sirens and the officer on the loud speaker saying kill the engine. so I kill the engine and prepare to tell the officer what I was doing, before I could do that I was cuffed on the car and read my rights. to make a long story short they was not trying to hear what I had to say, they arrested me, impounded my bike and gave me five summonses for Driving on the sidewalk, no helmet, Unlicesed Operator, reckless endangerment and Unregistered Vehicle. Now I have to go to court for this bull$#!^... I have no criminal Background and everything with the bike is ligit. I am ready to pay a very large summons. But heres the funny part, I got a letter in the mail saying that the cops couldnt produce enough evidence so they dropped the Reckless Endangerment and Unregistered vehicle. Unlicensed operator I will beat becuase you cant get a license for a quad in NY. How should I plea? I just want my Sheee to come home.... loganskinner Posted August 23, 2004 Report Share Posted August 23, 2004 what happened at my arrainment hearing was, they called me up, the states attourney told me what i would get if i plead guilty, (which was $500 fine and court costs) so i plead "no contest" that means that i am not saying that i did it, but im not contesting it and saying that i didnt. "no contest" just means that you are willing to take the deal the states attourney gave you, and get it over with. no trial, just get it over with there. Never been caught, almost did but managed to escape the cops wrathe...ever since then, I don't risk it. They are going to let you off easier if you are remorseful for what you've done. Be careful -- don't use your explanation as an excuse because that is not being remorseful. If you use it as an EXPLANATION in conjunction with your remorsefulness, you'll be much better off. Don't say.. ."well I was just taking it for a spin down the sidewalk to get my yadda yadda adjusted because I figured it was OK". Explain that yes, you messed up and are sorry, and you didn't realize that deciding to [fill in whatever your excuse is] was a bad choice at the time but understand your actions now and would never do it again. Or whatever. Obviously if you plead innocent and try to fight it, scratch what I said above, but still be sincere, honest, and humble. If they find you guilty, be remorseful. BansheeJerry Posted August 24, 2004 Report Share Posted August 24, 2004 I got a DWI on my shee last year riding the RR tracks. Was arrested,shee impounded. I lost my license for 4 months only because I refused to blow the brethalizer. The judge thought it was crazy and gave my 1 year unsupervised probation with no fines just court costs. (I know I got real lucky) My advice is to be honest and respectful and you should be alright. If you cant beat it ask for a PPJ (probation before judgenment). That means you will be on probation for a specified amount of time and if you dont get into anymore trouble it wont go on your record.Good luck and let us know how you make out.
