I had a good day

Recommended Posts

A little over 2yrs ago I sprained my ankle at work. Not being one to not

get what is coming to me, I started following up on my workmans comp

claim. I've been working for about 17yrs and with my current employer

for 10 and this is the first work related injury I've had. Well long story

short, after rattling there cage, the insurance company offered me $1700

about 6weeks ago. The injury was not disableing and I am not greedy so

I accepted. A couple days later I was contacted by the adjuster and advised

of the settlement procedure and was told that they were going to make it an even $2000. That was cool. Well today I went before the settlement board

to be advised of my rights and to sign the settlement agreement. It was just

me, a lawyer for the insurance company, and a very nice lady judge. She

reviewed my file while I sat there. She then asked the lawyer what they had

offered and he said 4% disability which calculated out to $2000. She then

asked me about my injury. She then proceeded to explain to the lawyer that

she felt that, based on my case, 7.5% was a more fair and accurate

representation of my level of disability. She and the lawyer both punched

on their calculators and agreed that worked out to $3800  .

I couldn't believe it! I love her! I never thought the system worked like that.

When I accepted $1700, I certainly didn't think it would turn into $3800.

Can you say Cheetah!!!

We had something similar happen at the shop this week. It must be something new these lawyers are trying....something along the lines of not fucking anything that moves out of what ever it has.

Company X filed bankruptcy on my machine shop in 01. $26,000 and some change.

We go through the process of filing our paper work to get something on that bill....

Time goes by....

more time...

Company X is bought, along with their debt by Company Z

Company Z assumes all debts previously incurred by this bankruptcy. About $3 million dollars.

We still do some work for Company Z now....

We get a note from an attorney saying anything that Company X paid us 90 day prior to them filing for bankruptcy back in '01 is due to them in 2 weeks. A total of $4,000. Basically the Company Z is NOT paying the debts of Company X like he said he would. All of us have to surrender this money for redistribution. Its a federal law.

My dad shits his pants.

He calls the attorney and the guy says "Send me invoices and bank statements I'll see if I can get you out of this. I have to sue you by federal law if you don't pay in 2 weeks, but I don't think you should pay. Its just a judgement handed down."

My dad shits his pants again.

He sends in paper work

Lawer calls back a week later (money is now due in one week) "Sorry...it appears that all of this you sent in falls under these guide lines."

My dad tells him that we don't have $4000 and he would have to take it out of his retirement fund.

The Lawyer says "However, since you only owe $4,000 and company X took you for over $26,000 I'll call the judge and tell him that it would cost us $6,000 to collect it, and it wouldn't be worth our time."

My dad thinks about going to church for about 10 seconds.

Lawyer calls back 15 minutes later 'Your debt has been cleared. Keep your paper work. Have a nice day"

My dad shits his pants again.

Never once have I met an attorney that actually gave a shit about doing something for someone like this. AND it cost us ZERO!!!!

Glad to hear about yours Banshee04le.
