got1banshee Posted May 12, 2004 Report Share Posted May 12, 2004 Were do I start. Last november I bought a banshee from a kid that worked for my a kid that I trusted. Month goes buy and he blew up his worrier and put that in my storage building. About 2 or 3 days after that a cop comes up to me telling me that my ATV is stolen I told him where I got it and how much I gave for it and that I had a bill of sale. The kid that worked for my stoled 3 atvs and the cops have one and he said that I had the other two. to make a long story short I am getting charged with 2 count of recieving stolen property. I get an attourny and he talks to the prosicuter and because the kid that worked for my was only 16 they will put all the charges on me. The prosicuter told my attourny that they will drop one of the chargeds if I can pay restitution up front. I thought that the restitution can't be much so I say ok. About 4 months of talking to the prosicuter goes by and they now say that they will other drop all the charges IF I PAY all the restitution up from or the will charge me with both counts of recieving stolen property. I said that I would pay the restitution , thinking that it can't be much. The kid that worked for me blew the motor in the worrier so thats the restitution buy a new engine for a worrier that I didn't have. I requestion a detailed list of all the parts that are messed up on the quad. They want 2430 bucks to rebuild the engine. WTF!!!!!!!!!! So the bottom line is that I have to come up with 2450 in 3 weeks and pay my atterny another 1000 so that 3450 or I lose everything I have and get locked up for a minumum of 1 year and still have to pay the restitution when I get out. SO I dont know what to do other that sell my quad or my trailer or start a Please Save Rick foundation. I am so stressed out I just want to shot my self!!!!!!!!!!!!!!! You can't trust your soul to no backwoods southern lawyer\And the judge in the town's got blood stains on his hands. I'd say fire your lawyer. That's messed up. If you got a bill of sale it should prove that you had nothing to do with the thefts. The owners should have had insurance on the stolen machines which should cover the cost of the quad all togather regardless of what happened to it once it was stolen. If you have a bill of sale I don't see how they could put it on you...at all, they need to be after the one you bought the shee from & who provided you with a bunk bill of sale. If the DA is comming up with all these offers instead of charging you with a crime then its because they know their case is weak! I know its the scaryier option but I say tell the DA - FU and fight it. Get a new lawyer if you have to. Take it from me, if they think there is a chance their going to losse, and it seams like you have a solid case in your favor to me, they will drop it when push comes to shove. I don't mean like yell at him, I mean corner him and beat some sense into him. Also, if you have a bill of sale, and can show a cancelled check etc...you should just have to hand over the stolen goods. I would also talk to a different lawyer. Attorneys can get you in or out of anything. There is someone I know that has had 3 felonies EXPUNGED from his record, all because of who he knows. One of the felonies came with a $10,000 bill. Restitution is paid directly to the victim and does not involve the court #2 Court fines are paid when you end up on probation. Does the court make the money? no, it's to pay your own damn way through probation! #3 Courts make their money mostly from traffic tickets and taxes. I bought a stolen bike last year from a friend that said he didn't know it was stolen. After I spent $1500 in restoring the bike I went to register it. I knew when the cops showed up at the dmv that something was up. They followed me back to the house and took it on the spot. I didn't get shit back out of it. The cop said that it would be very hard even if I knew it was stolen for them to prove I knew it. They left and didn't do shit to me. They even went to the guys house I got it from and didn't do shit to him either. Drop the shitty lawyer. Tell them to prove that the bike wasn't blown up before it got stolen. The fact is they have to have proof. It does sound scary but you need to fight this if you had no idea it was stolen. Even if you did they can't prove it unless its on tape. Have you been in trouble before? Are you working? These are things your lawyer should be building a case for you with. Tell them to show you the proof. Get a new lawyer. Talk to another lawyer got1.....with a bill of sale it should not be on you in any way. You didnt receive stolen property to your knowledge or have any idea that it was stolen....thats the only issue they could push...that it was a kid that works for you and you "knew" that it was stolen. Other than that they are pushing all these negotiations with you because they dont have a strong case.
