Liscense Requirement?

A couple years back in my 85 tpi trans am (one of the very very first tpi's out there) that was in mint condition that I got off my uncle and was out waxing the thing every weekend.....

 

Some guy in a plymouth reliant did the same exact thing to me, pulled out right in front of me, didnt have time to hit the brake and hit him dead center between the doors with the drivers side front of my car. If I didnt swerve to the right I woulda hit right into his door and he'd be one hurting pup, even with that, they still charged the case 80-20 at fault in my favor because of where the hit was. Just plain sucks, and they totaled my trans by 250 dollars. Bought it back for 400 and sold it to my parents neighbor for a grand and he's fixed it all up....but it has a reconstructed title now.

 

Good luck man. Are the witnesses names taken down and such? The accident report will be the deciding factor for the most part in a court case. They can do inspections of how bad your vehicles are messed up to see how fast you were going, but for the most part, they just go by skidmarks. They dont like going through all the work of vehicle inspections, and probably wont if the guy lives, but if he dies it'll be a whole new ballgame. It's completely not your fault....but I'm sure they'll try to find a way that it was. Stupid shit like since you were driving a truck, you should of been defensively aware of some old person that might just pull out in front of you. It sucks...but people are ruthless.

Its not law here in MA but the general guideline is if you T-bone someone from center to front its their fault, if you hit em aft of the passenger compartment its your fault (state believes you could have manuveured in this situation).  Since we are both no fault states its probably the same. 

 

I think you'll be found not at fault because you hit him dead center.  Here i've never heard a person faulted for a dead center hit  (unless they ran a redlight or stop sign).  Take it for what its worth.

Lesson learned? Aim for the front!!!! :evil:

When I was 17, I had a 72 cutlass and I was making a left hand turn onto a 4 lane road in the rain. traffic was backed up for a stoplight, and an old guy was nice and let me out. I proceeded cautiously, and this ass in a jeep wrangler flew around traffic into the inside lane, did'nt even try to stop, and I could'nt go, cause of the rain(traction non existant). He T-boned me so hard, I hit both doors, and my car literally bent in half. You know what? That bastard sued ME. Yes, He had the right of way, and I got a ticket for "failure to yield on a left turn" According to the law, I was the one at fault, even though that guy was speeding, AND had plenty of room to try to stop.

I don't think they'll be able to get anything out of you, if it was them who pulled out in front of you.

damn boon, i hope you get outta that with a lot of hassle and shit, at least u werent driving the truck and hit the car, the whole thing would be crushed! for the paint that'll suck, i would be sueing them, they were at fault and ur being held back because of there actions

Sorry to hear you had a bad week. But it sounds like a cake walk compared to what that old man and his wife are going through. You ought to be thankful you walked away from it with just a little inconvienence and can spend another day with your wife and family.

You seee, that's the problem with this whole thing. We all lose sight of the fact that this guy should NOT have been in a car to begin with. After conversing with some locals this weekend at my bar I tend at, I have come to this conclusion. I was told by NUMEROUS waitresses at the local restaurant that they were coming from when I hit them that the gentleman always held out his change in his hand for the waitress to count out for him because he couldn't see the chhange and/or decipher between the different denominations. I also talked to a family member of theirs, who also verified that he couldn't see very well. So, my question is, how do these folks in the same shape as him get into a car legally? If someone my age, or even under 50 in normal health had been driving that car, they would have walked away as well. Just like I did. I am thankful EVERY DAY I wake up that I get to spend it with my wife and son. I don't need an accident to wake me up for that. I kiss them both every day before I leave for work. Before I do anything. I love my family. Nothing will change that. But It is my feeling that something needs to be done to rectify this situation. Had I not had another vehicle, I would be screwed right now. And Benny, the vehicle I was in was the S-10 with the stock 4.3 motor. My other one with the small block is in the garage with the motor out. Awaiting replacement. But, I have come down with some ailments lately, so we'll see what happens...... :shootself:

I feel bad for the older folks that don't get along like they used to. The best thing is to just take the licenses from them.

 

I know a guy that was travelling down a divided highway that has intersections with stoplights. It was 55mph, so you can figure 60. As he approached an intersection (maybe 120 or so feet at 60mph) the light at the intersection turned yellow. From what the witnessess said, there was a woman in the oncoming left hand turn lane, and as soon as that light turned yellow, she stomped on the gas to make her turn. This guy I know didn't even get the chance to hit his brakes. His suburban demolished this womans car, and ended up killing the passenger.

They tried to sue him, but between the witnessees, the accident investigators that use a tried and trued method called PHYSICS to determine what really happened, it was tossed out of court. She pulled out in front of him as he was travelling 60 mph. No brake marks what so ever from his suburban either. He survived just fine though with a few bruises from his seat belt.

Ah, man that sucks. I'm sure you'll get out of it fine though.. witnesses are hard to cover up, and considering the information and proof you have regarding his eyesight... you shouldn't have any problem getting out of that. Totally sucks though.. sorry to hear that.

 

I agree on the eyesight thing. Lots 'o people out there shouldn't have a license. Maybe not even because of eyesight but because of lack of reflex, reaction times, etc..
