Trans keeps popping out of first

So guys this has got me completely baffled about whats going on here.  The mot just got completely torn down to look for the problem with first gear.  I figured it was a bent shift for or something along those lines but when I got it all tore down the case had a crack in it on the inside it was letting the counter shaft move back and forth a bit.  So I got new cases and also inspected the shift drum and forks for damage and nothing.  I put the bottom end back together and then I put a drill on it and it shifted perfect with no load.  I figured it was just the cases and moved on to putting it back together and back in the bike.  Well I got it all done and did some break in of the engine and when I was gonna take it out slow around the yard put it in first and guess what it popped right out or half way out of first.  Its almost like it will go in and out in and out.   So to make a long story short pulled the clutch cover back off and noticed this.  In this video you can see at the very end that when I roll the tire with my had the shift star is spinning up almost into neutral.  Check it out tell me what ya think.  My idea is maybe the spring on the detent bearing arm.  Or maybe the shift drum itself even though it has no wear what so ever..  

 

Any help would be great this is driving me crazy

let me look its shifts normal all through the gears but when I put it down in first it goes in then pops out then it pops back in.  let me look again to see what part your talking about.  Its a pain in the ass to see I know but at the end of the vid you can see the shift star rock back almost into (N) its wierd
