Should i give him $750 for the bike and trailer and then swap the frame? I know he rebuilt the bike ast year and got the toomey's. Is that worth it? If you take the bike and trailer, get a bill of sale signed by him. Last thing you need is hot property at your house. I still would not give more than a 50 to 100 dollar deposit... He said he would give me a bill of sale with it. Im not gonna give him anything until i see a clean title. Or ill tell him to get the frame and ill buy it once its all done. Nah, im no gonna pursue it anymore. I just though it was kinda win win if i give him cash and worse case scenario i cant getthe title i would get a new frame for 400 bucks and still spend less than 1500 for the bike and 2 bike trailer. jayzx10r Posted November 7, 2008 Report Share Posted November 7, 2008 I don't know how this works, but: If this guy walked into his local DMV with whatever paperwork he had for the Banshee, wouldn't the DMV forward notice to the mechanic (or whoever has the lein) that there was movement on the title and afford him an opportunity to collect within a certain time frame? And after that time passed, wouldn't the DMV give up a clean title if their wasn't a response? And if he did respond, this guy would receive a bill for work completed, which could be paid off. So it seems to me that if the guy that currently has the Banshee could be handed a post dated deposit check for something less than the trailer itself is worth only, and give this guy the banshee and trailer so he could initiate DMV transfer. Depending on the outcome of whether the leiner responds or not would determine how the agreed upon sales price funds were distributed. If it was more than the 'shee was worth, cancel payment on the check and walk away. Might as well let the state do the work for you if you really like this banshee that much..... Dick Wheels Posted November 7, 2008 Report Share Posted November 7, 2008 3 choices... #1 - Walk (best choice) #2 - Buy it and pretend you didn't (stash it away and buy a new frame with clean title) #3 - Play the NY State Game (NY plays hard ball, I know I live here. possible;e losing battle) I'm still gonna say walk but if you really want it that bad, Buy it and and pretend you don't have it till your clean frame comes in with paperwork and only ride it after everything has been transferred to new frame and old one hacked to pieces and disposed of! The only problem is, civil court is involved. DMV knows that. DMV ain't gonna just put someone else's name on a title, knowing that there is a mechanic's lein on it. Don't touch the thing until the lein is paid in full and the bike is in your friends name. Don't take the bike and switch frames. That's stupid. I'll put this in words that everyone will understand. Not only is it way too much work, and will be spending more money for a frame, but you're buying a potential STOLEN Banshee. Then after you buy it, you plan on chopping it, and giving it a clean VIN. How would you feel if your bike was stolen, you reported it to the police, and someone just changed the VIN so you can't get it back? There's nothing different. When the lein is not paid off, and that guy wants the bike and it ain't there, you can bet your ass it will be reported stolen. Now, you have a stolen four wheeler, that's been chopped. You ain't no better than some of the other idiots that come on here asking how to hot wire a stolen banshee. Or, where is the VIN so I can grind it off. My best advise to you is, if you want this bike that bad, wait until your friend takes care of his problems first. When it has a 100% clean title, then get it. You don't need the headache. If it doesnt sell and he gets the title I'll jump on it. He was saying he can get the title with no problem, So if it was meant to be, it will be.
